Terms & Conditions 

1. Acceptance of Terms

By enrolling in coaching services, purchasing a payment plan, attending in-person sessions, or using our website, you agree to these Terms & Conditions, including the Liability Waiver.

If the rider is under 18, a parent or legal guardian must agree on their behalf.

2. Nature of BMX & Assumption of Risk

BMX riding is an extreme sport involving inherent risks including, but not limited to:

  • Falls

  • Collisions

  • Equipment failure

  • Serious injury

  • Permanent disability

  • Death

You acknowledge that participation is voluntary and you accept full responsibility for all risks associated with BMX activities, whether supervised or unsupervised.

3. Release & Indemnity

To the maximum extent permitted by law, you:

  • Release and discharge [Business Name], its coaches, contractors, affiliates and representatives from any claims, liabilities, damages or expenses arising from participation.

  • Agree to indemnify and hold harmless [Business Name] against any claims resulting from your actions or participation.

Nothing in this agreement excludes rights under the Australian Consumer Law.

4. Services Provided

Services may include:

  • 1:1 online coaching

  • In-person sessions (SEQLD where applicable)

  • Strength & conditioning programs

  • Nutrition guidance

  • Trick development systems

  • Competition preparation

  • Ongoing rider mentorship

We reserve the right to modify services at any time.

5. Payment Terms

  • Payment plans must be paid in accordance with the agreed schedule.

  • Payments are non-refundable unless required by law.

  • Missed payments may result in suspension of services.

Payment Default Clause

If payment is overdue:

  • Coaching access may be immediately suspended.

  • Outstanding amounts may be referred to a debt recovery agency.

  • The client remains liable for any recovery costs incurred.

6. Cancellation Policy

  • Minimum 24 hours’ notice required to reschedule in-person sessions.

  • Failure to attend without notice may result in forfeiture.

  • Subscription cancellations require written notice via email.

7. Rider Responsibilities

All riders agree to:

  • Wear appropriate safety equipment (helmet mandatory).

  • Follow coach instructions at all times.

  • Act respectfully toward coaches, riders, and venue staff.

  • Disclose injuries or medical conditions.

  • Avoid unsafe or reckless behaviour.

8. Code of Conduct

We are committed to maintaining a safe, professional and respectful environment.

The following behaviour will not be tolerated:

  • Bullying or harassment

  • Dangerous disregard for safety

  • Substance use during sessions

  • Abuse toward staff or riders

Breach of this Code may result in immediate termination of services without refund.

9. Medical & Fitness Declaration

You confirm that:

  • You are physically fit to participate.

  • You have disclosed all relevant injuries or medical conditions.

  • You understand BMX training places significant stress on the body.

We are not responsible for injuries resulting from undisclosed medical conditions.

10. Media Release

You grant [Business Name] permission to:

  • Photograph or film training sessions.

  • Use images, videos, and riding footage for marketing, website, social media, and promotional purposes.

  • Edit and publish content without further approval.

If you do not consent to media use, you must notify us in writing prior to participation.

11. Intellectual Property

All programs, materials, trick systems, guides, videos, and content remain the intellectual property of [Business Name].

You may not:

  • Copy

  • Share

  • Reproduce

  • Resell

  • Distribute

Any breach may result in legal action.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for personal injury, property damage, or financial loss arising from participation.

  • Riders participate at their own risk.

This clause survives termination of services.

13. Governing Law

These terms are governed by the laws of Queensland, Australia.
